No-Fault Divorce: A Kinder, Simpler Way to Separate

Divorce is never easy, but recent changes in the law aim to reduce the emotional strain. Since 6 April 2022, couples in England and Wales have been able to divorce without having to assign blame, thanks to the Divorce, Dissolution and Separation Act 2020.

Under this no-fault system, couples no longer need to cite adultery, unreasonable behaviour, or long separation periods. Instead, one or both parties simply confirm that the marriage has irretrievably broken down. This significant reform allows couples to part ways more amicably, with less stress and conflict—particularly important for families with children.

How the Process Works

The no-fault divorce process includes:

  • A 20-week reflection period from the date the application is issued.
  • The opportunity to apply for a Conditional Order after 20 weeks.
  • A further 6-week+1-day period before applying for the Final Order, which legally ends the marriage.

In total, the process takes a minimum of 26 weeks, allowing time to sort out arrangements for children, finances, and living separately.

Who Can Apply?

To apply for a divorce in England and Wales:

  • You must have been married for at least one year.
  • At least one party must live in or have a permanent connection to England or Wales.
  • Your marriage must be legally recognised in the UK.

Can a Divorce Be Contested?

Contesting a no-fault divorce is rare and only possible on specific legal grounds—such as jurisdiction issues, an invalid marriage, or if the couple is already divorced in another country.
